
ATTORNEY FOR THE WORSE
Trumpās lawyers are having another rough one.Ā And theĀ mainstream media could learn a lesson from theĀ legalĀ profession and how it handles accountability for unethical behavior and corruption.

Lawyers for disgraced former President Donald Trump have a long, sordid, and darkly hilarious history of gettingĀ charged with crimes,Ā going to prison,Ā facing disbarment,Ā comparing Trump to a āmob boss,āĀ and warning the countryĀ not to re-elect him. This week, the saga of accountability for the former guyās band ofĀ legalĀ misfits continued apace. While 2020 coup lawyer and Trump co-conspirator Jeffrey Clark, was taking the Fifth over and over in his D.C. disbarment hearing yesterday, across the country, another corrupt Trump attorney faced accountability of his own. John Eastman was a key architect not only of the scheme to recruit fake electors, but also of the plan to convince Veep Mike Pence to reject legit Biden electors so the fakes could be slotted in on Jan. 6. Eastmanās professional colleagues in California noticed, and they donāt want him around any more.

As of a judgeās ruling yesterday, Eastman is no longer fit to practiceĀ lawĀ in the State of California. Unless he wins a longshot appeal, heāll be officially disbarred by Saturday. Itās worth taking a second toĀ look at Judge Yvette Rolandās ruling, because like so much of whatās become standard from Trumpworld, itās shocking. Roland wrote that Eastman lied in court documents, that he knew his fake elector and Jan. 6 plan was illegal, and that he repeatedly lied about evidence of voter fraud. She said Eastmanās conduct was worse than that of Nixon lawyer andĀ henchman Donald Segretti in Watergate. At least Segretti eventually acknowledged his crimes. Eastman, the court ruled, can no longer be trusted to practiceĀ lawĀ with honesty and integrity.

Now, just for fun, letās draw a comparison with parallel events in the media over the past week. Ronna McDaniel served as the head of the Republican National Committee for much of the Trump years and their messy aftermath. She operated in politics, not theĀ law, but followed the same playbook as Eastman. She trafficked lies about the election, pushed democracy-damaging conspiracy theories, and worked to undermine accountability for crimes (remember when the RNC called Jan. 6Ā ālegitimate political discourseā?). But NBC News executives still thought she was fit to act as a contributor and analyst in election coverage. That NBCās journalists so quickly rejected McDaniel as a liar unfit at the table of journalismāregardless of partyāwas heartening. But the fact that their bosses thought McDaniel deserved that seat shows how the mainstream media, eight years into Trumpās assault on democracy, still struggles to recognize what it means to defend its institution.Ā The RNC respondedĀ by threatening to limit NBCās access to this summerās conventionāin what amounts to saying, effectively: āAir our lies or pay the consequences.ā Itās a move that should prove to those execs that they arrived at the right decision, eventually.

Eastman, as we noted above, is far from alone. Manyānearly all, in factāof Trumpās cadre of coup-promoting lawyers have faced accountability in some form. Jeffrey ClarkĀ may be on his way to disbarmentĀ (heās also charged with crimes); Rudy Giuliani is charged andĀ canāt practiceĀ law; Jenna Ellis,Ā censuredĀ andĀ pleaded guilty; Ken Chesebro,Ā guilty; Sidney Powell,Ā guiltyĀ andĀ sanctioned.
Although it takes some time, theĀ legalĀ profession knows how to deal with fraudulent crackpots.Ā It has demonstrated an ability to defend its institution against the liars and cheats Trump has dispatched in his attack on democracy. Itās well past time the mainstream media outlets responsible for covering 2024 figure it out.
